Terms of Service

Hyperus OEE MCP · Last updated: September 26, 2026

These terms govern the use of the Hyperus OEE MCP server at https://mcp.hyperus.com.br (the “Service”), which lets you connect AI assistants (such as Claude, ChatGPT, Microsoft 365 Copilot or Cursor) to your Hyperus OEE data. By connecting the Service to an AI client, you agree to these terms.

Service provider: Hyperus Technology LTDA, CNPJ 46.793.344/0001-04, Rua Nova Jerusalém, 246, Sala 3, Terras de São José, São João da Boa Vista, SP, CEP 13874-816, Brazil.

1. Relationship to the Hyperus OEE agreement

The Service is an add-on to Hyperus OEE and is available only to users of companies with an active agreement. These terms supplement the Hyperus OEE agreement and terms accepted by your company. If they conflict, your company's agreement prevails.

2. What the Service does

Technical details are in the Documentation.

3. Account and access

4. Acceptable use

When using the Service, you agree not to:

5. Third-party AI clients

The Service works with AI clients provided by third parties (Anthropic, OpenAI, Microsoft, Cursor, etc.). Hyperus does not control these clients. When you connect one, query results are processed by that provider under its own terms and privacy policy. You and your company are responsible for deciding whether using that client complies with your internal policies.

6. AI-generated responses

The data returned by the Service comes from Hyperus OEE, but the interpretation, calculations and text presented by the assistant are generated by the AI model and may contain errors. Verify the information in the Hyperus OEE dashboard before making operational, safety, quality or financial decisions.

7. Data ownership

Factory data belongs to your company. Hyperus processes it only to provide the Service, as described in the Privacy Policy. The Hyperus OEE software, brand and documentation belong to Hyperus.

8. Availability and changes to the Service

9. Warranties and liability

The Service is provided “as is”, without warranties beyond those in the Hyperus OEE agreement. To the extent permitted by law, Hyperus is not liable for decisions made based on AI-generated responses, nor for the operation of, or data processing by, third-party AI clients. Hyperus's liability is subject to the limits in your company's agreement.

10. Termination

You can stop using the Service at any time by removing the connector in the AI client or ending the session in the Hyperus OEE dashboard. Access ends automatically if your account is deactivated or your company's agreement ends.

11. Changes to these terms

We may update these terms. The date at the top shows the latest version. Material changes will be announced through Hyperus OEE channels. Continued use after an update means you accept the new version.

12. Governing law and venue

These terms are governed by the laws of the Federative Republic of Brazil. The courts of São João da Boa Vista, SP, Brazil, have jurisdiction, unless your company's agreement provides otherwise.
